APPENDX 3 - AMENDMENTS

The following amendments have been approved by the ICC Board in accordance with Article 11.1 with effect from the dates set out below:

  1. Amendments with effect from 1 January 2021:

(a) Article 2.4.9 was added to the Code, together with its accompanying explanatory note, and the subsequent Article was renumbered.

2.4.9 2.4.9 Associating in any professional or sport-related capacity in cricket with any Excluded Person, after having been specifically warned against such Association, without the prior approval of the ACU.

NOTE:  In order for Article 2.4.9 to apply, it is necessary that (a) the Participant has previously been advised in writing by the ICC and/or his/her National Cricket Federation of the Excluded Person’s disqualifying status and the potential consequences of such prohibited Association, and (b) the Participant can reasonably avoid the Association.  


For the purpose of this Article 2.4.9, ‘Associating’ or ‘Association’ shall include interacting with an Excluded Person in any manner, including, without limitation, communicating with the Excluded Person by any means (including in person, telephonically, or by digital or electronic means), physically or virtually meeting, and/or receiving direction or instruction from the Excluded Person by any means.

2.4.10 Directly or indirectly soliciting, inducing, enticing, persuading, encouraging or intentionally facilitating any Participantto breach any of the foregoing provisions of this Article 2.4.

(b) The table in Article 6.2 was amended as follows:

Any of Articles 2.4.7 to 2.4.98 and 2.4.10 inclusive (General)

Any period from zero up to a maximum of five (5) years.

 

Article 2.4.9 (General)

 

Any period from zero and a reprimand up to a maximum of two (2) years.

 

(c) Article 9 was amended as follows:

ARTICLE 9 RECOGNITION OF DECISIONS

9.1 All National Cricket Federations shall comply with the Anti-Corruption Code and take all necessary and reasonable steps within their powers to recognise, enforce, extend and give effect to all decisions taken and Provisional Suspensions, Exclusion Ordersand sanctions imposed under the Anti-Corruption Code within their own respective jurisdictions, without the need for further formality. This shall include (without limitation), where it has the jurisdiction to do so, requiring the organisers of any Matches, tournaments or other events sanctioned by the National Cricket Federation to recognise and give effect to such decisions and Provisional Suspensions,Exclusion Ordersand sanctions.

9.2 Decisions made and Provisional Suspensions and sanctions imposed under the anti-corruption rules of National Cricket Federations shall be recognised, enforced, extended and given effect to within their respective jurisdictions by the ICC and other National Cricket Federations (including in respect of any Matches, tournaments or other events sanctioned by such National Cricket Federations), automatically upon receipt of notice of the same, without the need for further formality.

(d) Article 11.1 was amended as follows:

11.1 The Anti-Corruption Code may be amended from time to time by the ICC’s Board, with such amendments coming into effect on the date specified by the ICC***(as set out in Appendix 3)***

(e) The following new definitions were added to Appendix 1:

**Excluded Person.Any person who is the subject of an Exclusion Order.

**Exclusion Order.An order issued by the ICC pursuant to the ICC’s Excluded Persons Policy (attached at Appendix 2 and as may be updated from time to time) which excludes a person from playing, coaching, officiating, attending or otherwise participating or being involved in any capacity in any Match or other kind of function, event or activity, team, franchise, competition or league that is authorised, organised, sanctioned, recognised or supported in any way by the ICC, a National Cricket Federation, or any member under the jurisdiction of a National Cricket Federation, or receive accreditation to provide media or other services at any official venue or Match.

**Judicial Commissioner.The independent person appointed by the ICC from the ICC Code of Conduct Commission, to perform the functions assigned to the Judicial Commissioner under the Code.

(f) Appendix 2 and the Excluded Persons Policy was added.

(g) Appendix 3 was added.
