ICC Men’s T20 WORLD CUP 2024

HOSPITALITY TERMS AND CONDITIONS

1. Definitions.

All capitalised terms used in these terms and conditions (the “Hospitality Terms and Conditions”) have the same meaning as under the Ticket Terms and Conditions, unless defined hereunder or the context requires otherwise.

Booking Form” means the booking form relating to the Hospitality Package

Booking Confirmation Notice” means the official email issued by CWI confirming a booking

Customer” means the purchaser of a Hospitality Package

Designated Times” means the times during which the Customer will have access to the Hospitality Area

Guest” means the Customer and includes any person who has obtained a Ticket from the Customer who is permitted to enter the Hospitality Area and to enjoy the facilities and benefits of a Hospitality Package by invitation of the Customer

Hospitality Agreement” means these terms and conditions, the Ticket Terms and Conditions and the Booking Confirmation Notice

Hospitality Area” means the area within the Venue which is specified on the Ticket, in which the Hospitality Package is provided, access to which is limited and controlled for the benefit of Customers and Guests

Hospitality Fee” means the fee recorded on the Booking Confirmation Notice for the Hospitality Package(s) (and in the case of one of multiple Hospitality Packages, the fee related to that Hospitality Package)

Hospitality Package” means, for each Match, the services provided to the Customer subject to the terms of the Hospitality Agreement, as confirmed in the Booking Confirmation Notice or otherwise in writing by CWI. Such services may include but are not limited to: (a) Tickets for the Maximum Guests; (b) food and drinks as set out in the sales documentation provided by CWI; and (c) the right of access to and use of the Hospitality Area.

Match Date” means the calendar day on which a Match to which the Hospitality Package applies is scheduled to take place.

Maximum Guests” means the maximum number of Guests who are permitted to access and use the Hospitality Area and who will be provided with Tickets as set out in the Booking Confirmation Notice.

Ticket Terms and Conditions” means the ICC Men’s T20 World Cup 2024 Ticket Terms and Conditions as published at https://tickets.t20worldcup.com

2. Agreement.

2.1    This Agreement governs all Hospitality Packages issued for the Event and the subsequent admission to the Hospitality Area to attend any Match.

2.2    In the case of any inconsistency between a provision of these Hospitality Terms and Conditions and any other document forming part of the Hospitality Agreement, the provisions of these Hospitality Terms and Conditions will prevail.

3. Booking Confirmation.

3.1    When the Customer places a booking it shall be considered provisional until the Customer receives a Booking Confirmation Notice from CWI. Before any booking will be confirmed by CWI, the Customer must indicate the Customer’s willingness to accept the terms of the Hospitality Agreement.

3.2    A booking shall only be considered confirmed and this contract shall become effective upon issue of the Booking Confirmation.

3.3    The Customer acknowledges that availability of Hospitality Packages cannot be guaranteed and a booking request will be subject to availability at the time of receipt of the booking form by CWI.

4. Payment Terms.

4.1    Payment for a Hospitality Package and any other sums payable under this Hospitality Agreement will be in United States dollars (USD) unless otherwise stated.

4.2    A minimum deposit of 50% of the Hospitality Fee is required to secure a booking and the balance of any monies due must be paid at least one week prior to the Match Date.

4.3    If a booking is made within one week of the Match Date, the Hospitality Fee must be paid in full by bank transfer or as otherwise agreed by CWI at the time of booking.

4.4    If the Hospitality Fee is not paid in full within one week of the Match Date, CWI reserves the right to cancel the booking, sell the Hospitality Package or any component of it to a third party and retain all (or, at its absolute discretion, part) of any deposit paid, unless CWI has been able to resell the Hospitality Package, in which event the Customer shall be entitled to a refund of any monies paid, less any administrative fees or charges as set out in Clause 2 below.

4.5    CWI reserves the right to not release any documents or Tickets unless the Hospitality Fee has been received in full.

5. Tickets.

5.1    Subject to payment having been received in full by CWI, CWI shall send to the Customer as soon as reasonably possible, a Ticket for each Guest, in accordance with the details as notified by the Customer.

5.2    The Ticket, supplied as part of the Hospitality Package, grants the Ticket Holder a licence to access the Venue and the Hospitality Area for the sole purpose of attending the Event on the Match Date, provided that the Ticket Terms and Conditions and the Venue Regulations are complied with.

5.3    The Customer shall be responsible for distributing the Ticket(s) to Guest(s). No person will be admitted into the Venue without a valid Ticket. No liability is accepted by CWI in the event that a Guest is denied entry to the Venue as a result of the Customer’s or any Guest’s failure to comply with this Agreement.

5.4    Tickets which are lost will be replaced by CWI only on terms acceptable to CWI. CWI reserves the right to charge a replacement fee, in its absolute discretion, for every Ticket replaced. Requests to receive replacement Tickets must be submitted in writing to CWI.

5.5    The Customer acknowledges that CWI cannot guarantee:

5.5.1    whether a Match or any play will take place on the Match Date;

5.5.2    the length of play of a Match; or

5.5.3    the identity of the players who will appear in a Match.

6. Hospitality Area.

6.1    CWI grants to the Customer and any applicable Guests, the right to access and use the Hospitality Area during the Designated Times in accordance with the Hospitality Agreement, for the purpose of: (a) viewing the relevant Match; (b) making use of the Hospitality Package; and (c) activities ancillary to the foregoing; subject at all times to any rules and regulations relating to the relevant Venue and the Ticket Terms and Conditions.

6.2    The Customer shall be responsible for the acts and omissions of the Customer and the Customer’s Guests while at the Venue.

6.3    CWI reserves the right to determine the final location of the Hospitality Area within a Venue. Depending on the type of Hospitality Area, Guests may be limited to joint or shared use of the Hospitality Area.

6.4    Access to the Venue and Hospitality Area is strictly limited to the Match Date (including any reserve day if applicable), during the Designated Times.

6.5    CWI may, in its sole discretion:

6.5.1    terminate liquor service at the Hospitality Area at a certain hour, or at a certain time after completion of the Match on any specific day (notwithstanding that such time may be during the Designated Times;

6.5.2     require all Guests to vacate the premises within a certain time after completion of the Match on a specific day (notwithstanding that such time may be during the Designated Times);

6.5.3    remove intoxicated and/or disruptive persons from the Hospitality Area and the Venue; and

6.5.4    refuse to serve liquor to a person (including a Guest) under the age of 18 or who is intoxicated.

7. Hospitality Package Rules and Regulations.

7.1    Hospitality Packages may only be purchased from CWI or Authorised Agents.

7.2    Hospitality Packages must not be re-sold or transferred save as permitted herein and must not, under any circumstances, be auctioned, offered for sale or re-sale in any manner whatsoever or used in contravention of this Agreement.

7.3    Hospitality Packages are personal to the Customer who purchased the Hospitality Package and may only be used by Guests. The provision of Hospitality Packages and/or Tickets by a Customer to Guests without payment shall not contravene this Agreement.

7.4    The Customer, its own staff or clients are, without the express written consent of CWI, expressly and unconditionally prohibited from reselling, or allowing for resale any Tickets or Hospitality Packages, or any elements of the Hospitality Package purchased.

7.5    The Hospitality Package may not be sold as a whole or in part as part of another hospitality package or as part of a travel package or similar offering without the prior written consent of CWI (which may be given or withheld in its absolute discretion).

7.6    A Customer or Guest shall not purvey, advertise, auction or otherwise offer for sale, or use as a competition prize or for any other commercial purposes, the Tickets allocated to that person, without the prior written permission of CWI.

7.7    The Hospitality Package may not be used in any manner that would constitute a breach of applicable laws, regulations, codes and sanctions relating to anti-bribery and anti-corruption. If CWI reasonably suspects such use, the Hospitality Package shall be null and void and CWI shall be entitled to refuse entry to the Customer and the Customer’s Guests.

7.8    Any Hospitality Package acquired in breach of this Agreement shall be null and void. CWI shall be entitled to invalidate any Hospitality Package or Tickets which are offered for sale or acquired in contravention of this Agreement. Any person seeking to use a Ticket in breach of this Agreement in order to gain or provide entry to or remain at a Match may be refused admission or ejected from the Venue without compensation.

7.9    The Customer shall not be entitled to use the Event mark, or any marks, logos or trademarks of CWI, IBC, ICC, the Event or the Venue; or claim any association with the Event or the hospitality services without the prior written consent of CWI or IBC.

7.10    No identification banners, balloons or other advertising or promotional collateral, gifts/items whatsoever may be displayed by or on behalf of the Customer anywhere at the Venue or Hospitality Area during the Event without the prior written approval of CWI or IBC.

7.11    Unless otherwise expressly authorised by CWI or IBC in advance, to avoid ambush marketing or otherwise infringing any commercial rights in relation to the Event, Customers are not permitted to supply to their Guests items to wear or carry at the Venue during the Event. Subject to the foregoing, items that are very small in size and are intended for identification purposes only may be permitted, subject to samples of such items being submitted for written approval from CWI in advance.

7.12    Customers and Guests are strictly prohibited from possessing, selling or distributing any kind of promotional or commercial items in the Venue or Hospitality Area (including, without limitation, drinks, food, souvenirs, clothes and flyers). CWI (or anyone acting on behalf of CWI) may remove such items and/or remove the Customer or the Guests (as applicable) from the Venue or Hospitality Area, without any entitlement to refund or compensation.

8. Customer Obligations.

8.1    The Customer agrees to abide by all rules and conditions imposed by CWI and the Venue including, without limitation, the Ticket Terms and Conditions and the Venue Regulations; and any and all other conditions of sale applicable to Tickets as well as other rules relating to attendance at the Event. A Ticket forms part of a Hospitality Package and accordingly as a material condition of this Agreement, the Hospitality Package may not be used without a Ticket.

8.2    The Customer will not, and will ensure that Guests do not:

8.2.1    use (or attempt to use) the Match, the Hospitality Area or the Venue except as expressly permitted under this Hospitality Agreement;

8.2.2    cause any nuisance, damage, disturbance, annoyance, interference or inconvenience to any person or property of any person at the Match, the Hospitality Area or the Venue;

8.2.3    permit (or attempt to permit) Guests in excess of the Maximum Guests to access or use the Match, the Hospitality Area or the Venue; or

8.2.4    provide or consume food and beverage other than those supplied by CWI.

8.3    The Customer will, and will ensure that Guests:

8.3.1    ensure that any Guest under 18 years of age is accompanied and supervised at all times by a parent or guardian (who is 18 years or over);

8.3.2    comply with any dress codes in place at the Match, the Hospitality Area or the Venue; and

8.3.3    pay all charges for food and beverages requested over and above the included catering, immediately as required by CWI.

8.4    The Customer shall be responsible and compensate CWI for any loss, damage, costs and expenses (including, without limitation, loss of profits), that the Customer or the Customer’s Guests cause, whether within the Hospitality Area or elsewhere within the Venue.

9.    Substitution or Amendment.

9.1    CWI reserves the right to substitute or amend the Hospitality Package(s) (including without limitation any seats, areas or services initially allocated) if such amendment is required:

9.1.1    in order to comply with applicable local laws;

9.1.2    due to security constraints, Government directions, orders, regulations, public health advice or other reasons in connection with staging of a Match or the Event;

9.1.3    as a result of the cancellation of the Match and/or Event for any reason;

9.1.4    as a result of space re-allocation at a Venue for whatever reason; or

9.1.5    due to the unavailability of any food or drink or other items forming part of the Hospitality Package

9.2    In the event that CWI is obliged to make any material change to the Hospitality Package or cancel all or part of the Hospitality Package for any reason (including as set out in Clause 1 above), CWI shall use all reasonable efforts to provide the Customer with alternative arrangements which are of an equivalent standard. If CWI is unable to provide the Customer with an equivalent hospitality package, CWI may cancel the Hospitality Package and refund the Hospitality Fee (less any administrative fees or charges as set out in Clause 10.2 below.)

10.Cancellation by the Customer.

10.1    The Customer must notify CWI in writing if the Customer wishes to cancel the booking of the Hospitality Package and the Customer shall compensate CWI for any direct damage or loss suffered by CWI as a result of the cancellation. CWI shall use reasonable endeavours to obtain a suitable replacement customer but, where it cannot do so, reserves the right to charge the following cancellation fees:

More than one week before the Match Date:                          50% of any monies paid       

Less than one week before the Match Date:                          100% of any monies paid

10.2    In the event that the cancelled Hospitality Package is re-sold, CWI shall be entitled to retain a handling fee of 10% of any monies paid and the balance shall be refunded to the Customer.

11. Cancellation on the day and Alternative Arrangements.

11.1    The Customer acknowledges that the commencement and/or duration of any cricket played on the Match Date is dependent upon the weather and other factors that are outside the control of CWI; but that the hospitality facilities are not dependent on the weather on the Match Date and may be available for use irrespective of whether a match is interrupted, suspended or cancelled.

11.2    If a Match is cancelled prior to access to the Hospitality Area being given on the Match Date and the Match does not have a scheduled reserve day, the Customer will be entitled to a refund of the Hospitality Fee (less any administrative fees or charges as set out in Clause 2 above).

11.3    If a Match is postponed to the reserve day after access to the Hospitality Area has been given on the scheduled first Match Date:

11.3.1    the Hospitality Package will be deemed to have been provided by CWI and the Customer will not be entitled to a refund of the Hospitality Fee other than any refund of the Ticket component of the Hospitality Package, in accordance with the Ticket Refund Policy;

11.3.2    the Customer (and any Guests) will be entitled to use the Ticket(s) to attend the Venue and Hospitality Area on the reserve day; and

11.3.3    CWI will provide a reasonable and appropriate hospitality offering on the reserve day, taking into account the duration of play on the reserve day.

11.4    If a Match is postponed to the reserve day prior to access to the Hospitality Area being given on the scheduled first Match Date; the Customer will not be entitled to a refund and the Hospitality Package will be transferred to, and provided on, the reserve day. The Customer will not be entitled to receive the Hospitality Package on the original Match Date. If a Match is transferred to a reserve day, and on the reserve day, the Match is cancelled prior to access to the Hospitality Area being given, the Customer will be entitled to a refund of the Hospitality Fee (less any administrative fees or charges as set out in Clause 2 above)

11.5    Once access to the Hospitality Area is provided on the Match Date, the Customer will not be entitled to a refund of the Hospitality Fee other than any refund of the Ticket component of the Hospitality Package.

11.6    Eligibility for a refund of the Ticket component of a Hospitality Package will be determined, and any refund made, in accordance with the Ticket Refund Policy.

12. Liability.

12.1    CWI excludes all warranties, terms, conditions or undertakings of any nature and in any form (whether express or implied, written, oral, statutory or otherwise) in relation to the Hospitality Package(s).

12.2    CWI shall not be liable for:

12.2.1    any loss, injury or damage to property or persons whatsoever (whether caused by negligence or otherwise) suffered by the Customer or Guests or by any third party arising from use by the Customer or Guests of the Hospitality Area during the Designated Times; or

12.2.2    any special, indirect, incidental or consequential loss, including but not limited to, any loss as a result of a postponement, cancellation, rescheduling or relocation of any Math, any loss of profit, savings, or any losses in relation to accommodation and/or flights arising under, or in connection with, the Hospitality Agreement; or

12.2.3    any damage, loss, delay or expense incurred by the Customer owing to any event beyond the control of CWI

12.3    CWI shall not be liable to the Customer in contract, tort (including negligence) or otherwise arising out of or in connection with this Agreement for: (a) any loss of revenues, loss of profits, loss of business or anticipated savings, loss of goodwill and/or reputation or loss arising out of business interruption (whether such losses are direct or indirect); or (b) any indirect or consequential loss or damage.

12.4    CWI’s total liability if such an event arises shall be limited to the amount actually received from the Customer for the Hospitality Package.

13. General.

13.1    These terms and conditions, the Booking Form and the Booking Confirmation Notice shall be incorporated into the Agreement between CWI and the Customer.

13.2    The Customer shall not assign, transfer or sell the Hospitality Package or any Tickets to any third party.

13.3    This Agreement (and any documents referred to in these Terms and Conditions) sets out the entire agreement and understanding between the parties in respect of the subject matter of this Agreement. The Customer acknowledges that he has entered into this Agreement in reliance only upon the representations, warranties and promises specifically contained or incorporated into this Agreement and, save as expressly set out in this Agreement, CWI shall have no liability in respect of any representation, warranty or promise made prior to the date of this Agreement unless such representation, warranty or promise was made fraudulently.

13.4    This agreement may only be varied by an agreement in writing signed by or on behalf of each of the parties.

13.5    No failure or delay by CWI to exercise any right or remedy provided under this Agreement or by law shall constitute a waiver of that (or any other) remedy, nor preclude or restrict its further exercise. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that (or any other) right or remedy.

13.6    This Agreement shall be governed by the laws of Antigua & Barbuda and each of the parties irrevocably submits to the exclusive jurisdiction of the courts of Antigua & Barbuda.
